ASSAULT AND LARCENY
The crime of assault occurs when one person unlawfully causes physical injury or substantial pain to another. A person commits an assault by striking, beating, kicking, choking, or wounding another person. Assault can be either a felony or a misdemeanor depending on the severity. In the past, crime of assault referred only to the threat of physical injury; the crime of ‘battery’ referred to the actual physical contact. Modern criminal statutes have abolished assault and battery as separate crimes and use the term ‘assault’ to cover both acts.
Larceny. International stealing (taking and carrying away) money or the personal, movable property of another person is known as larceny. The law classifies larceny as either grand larceny or petit larceny, depending upon the value of the property stolen. For example, stealing an item worth from $50 to $250 would be petit larceny in most states. Petit larceny is generally a misdemeanor, while grand larceny (usually involving amounts over $250) is a felony.
