Solicitors and Barristers
In the English legal system a practicing lawyer must help one of two professions: he must either practice as a solicitor or have been called to the Bar as a barrister.
A barrister is to have an accepted educational standard, to have passed the legal examinations conducted by the Council of Legal Education and to have become a member of the Inns of Court. Most barristers are professional advocates earning their living by the presentation of civil and criminal cases in court. They become specialists at advocacy. Professionally acting barristers are known as «counsels». They may be appointed Queen's Counsels.
A prospective solicitor must be a qualified lawyer. The solicitor can be an advocate in the inferior courts bur he is more familiar to the public in his role as a general legal adviser. He may become the member of the Law Society.
A significant difference between the two professions is that members of the public are to call at a solicitor's office and seek his evidence in a personal interview: whereas a barrister can only be consulted indirectly through a solicitor. It can be sees that there is a possible analogy in these circumstances to the medical profession, with the solicitor as a general practitioner and the barrister as a consultant. The analogy must not be taken too far, however, since the legal knowledge of the newly qualified barrister is not to be compared with that of the senior partners of a firm of solicitors, whose legal experience may extend over many years and cover different fields of law. In many instances too the solicitor is more of a specialist than the barrister, particularly where the latter is ah advocate with a common law practice.
